Summary
The foundational definitional order. Declares U.S. policy to "recognize two sexes, male and female," defines "sex" as immutable biological classification fixed "at conception," and defines "gender ideology" as a concept that "replace[s] the biological category of sex." Directs: (1) all agencies and documents to use "sex" not "gender"; (2) State and DHS to require government-issued identification documents, including passports and visas, to reflect sex as so defined (ending the X marker and self-selected markers); (3) BOP to house transgender women in men's facilities and to end federally funded gender-affirming care in custody; (4) agencies to ensure sex-separated single-sex spaces (shelters, prisons, rape crisis centers) are designated by birth sex; (5) agencies to end federal funding of "gender ideology" and rescind guidance documents inconsistent with the order (a list of 11 named guidance documents); and (6) OPM to conform federal-workforce policy. EO number 14168; 90 FR 8615 (Jan. 30, 2025).
Status
Largely in effect. Passport provision: preliminarily enjoined nationwide for a certified class June 17, 2025 (Orr v. Trump, D. Mass.), but the Supreme Court stayed that injunction November 6, 2025 (Trump v. Orr), allowing sex-at-birth passport issuance to resume while litigation continues (see sections 6, 10). Prison provisions: enjoined as to Bureau of Prisons transgender prisoners with gender dysphoria (D.D.C., Lamberth, J., preliminary injunction June 3, 2025; earlier TROs Jan. 30 and Feb. 4, 2025) (see section 7). Funding provision §3(g): enjoined as applied in Washington, Minnesota, Oregon, and Colorado (W.D. Wash., Mar. 1, 2025). Language/website and workforce directives in effect, with a Feb. 13, 2025 order (D.D.C., Bates, J.) requiring restoration of some removed health webpages (see section 12). Update, Sept. 23, 2026: As to the passport provision specifically (this order does not touch the prison, funding, or workforce provisions of the same EO addressed elsewhere in this entry): On Sept. 17, 2026, the court (Kobick, J.) granted plaintiffs' Rule 56(d) motion and denied without prejudice the pending cross-motions for summary judgment (D. Mass. No. 1:25-cv-10313, ECF 145, 174, 187, 200), setting a schedule under which fact discovery closes March 31, 2027, dispositive motions are due Aug. 13, 2027, and a status conference is set for April 1, 2027; the passport policy remains in effect in the meantime.
