Summary

A department-wide memorandum implementing EO 14187 that: (1) directs all U.S. Attorneys to investigate suspected "female genital mutilation" — expressly including care provided "under the banner of so-called 'gender-affirming care'" — under 18 U.S.C. § 116 and to "prosecute all FGM offenses to the fullest extent possible"; (2) directs the Civil Division's Consumer Protection Branch to investigate manufacturers and distributors of puberty blockers and hormones for FDCA misbranding/off-label promotion; (3) directs the Fraud Section to pursue False Claims Act investigations of providers billing federal health programs for gender-affirming services; (4) orders identification and withdrawal of Department filings relying on WPATH standards; (5) announces draft legislation to expand § 116 and create a private right of action for detransitioners and parents, plus a state-federal "Coalition Against Child Mutilation." Federal courts later found subpoenas issued under this program improperly purposed (see 2025-09-09, 2026-05-13, 2026-06-24, 2026-07-02). (See also section 2.)
