| ENDORSED ORDER. Text of Order: The parties' arguments regarding Bernier's Title VII claim appear to rely upon arguments and caselaw that are currently being considered by the United States Supreme Court in Little v. Hecox, No. 24-38, and West Virginia v. B.P.J., No. 24-43. While the issues presented in those cases are not identical to the issues presented by Bernier's Title VII claim, the court is concerned about the possibility of ruling inconsistently with the Supreme Court's opinions in those cases. Therefore, on or before February 6, 2026, the parties are directed to show cause why this court should not stay consideration of their cross-motions for summary judgment pending the opinion(s) in Hecox and B.P.J. So Ordered by Judge Landya B. McCafferty.(vln) | |||

| ENDORSED ORDER denying as moot 97 Motion to Strike. Text of Order: Bernier moves to strike (doc. no. 97) a declaration Turbocam attached to its reply brief in support of its summary judgment. Turbocam states that the declaration at issue is only relevant to defend against liability for a mixed-motives claim under 42 U.S.C. 2000e-2(m). The court does not read Bernier's complaint or her summary judgment briefing as attempting to raise such a claim. As the declaration is not relevant to any issues to be addressed at summary judgment, Bernier's motion to strike (doc. no. 97) is denied as moot. So Ordered by Judge Landya B. McCafferty.(de) | |||
