Summary

A memorandum for the Adjutants General of the several states and the Commanding General of the District of Columbia, titled "Actions on Defending Women Executive Order." It references both the January 29, 2025 OPM memorandum and the January 31, 2025 Hegseth memorandum and directs completion, by March 28, 2025, of enumerated actions including "[e]nsur[ing] that intimate spaces designated for women, girls, or females (or for men, boys, or males) are designated by sex and not identity." Because the National Guard Bureau is the statutory channel of communication between the Departments of the Army and Air Force and the states (10 U.S.C. § 10501(b)), this memorandum is the mechanism by which the federal mandate reached every state National Guard. Withrow's EEO counselor identified this memorandum as "the discriminating event" giving rise to her complaint; she received it from the state Equal Employment Manager on March 7, 2025. The memorandum supplies no justification grounded in employee dignity, safety, or operational efficiency.

Status
